Construction accidents are a far too common occurrence in Texas. Scaffolding, heavy equipment, fork lifts, tractor trailers and cranes are just a few of the hazards to be encountered on a common construction site in Texas. Many construction accidents are the result of safety standards not being met by employers, contractors or heavy equipment operators. Many times the injuries are the result of inadequate staffing, unreasonable project deadlines and lack of communication between contractors.

Most employers providing construction services in Texas carry workers' compensation insurance. If the employer does have workers' compensation insurance, the injured worker should be provided weekly benefits while unable to work, as well as medical benefits allowing the worker to obtain necessary medical treatment. Even though workers' compensation insurance exists, the injured worker may have sustained injury as the result of the negligence of another contractor or business entity located at the construction site. In these situations, the injured worker may be able to bring a claim against these entities for his/her damages. Also, should the employer not carry workers' compensation insurance, the employer itself may be sued for the personal injuries.

Many times, prompt access to the site of a construction injury or death is required in order to properly evaluate the liability of all involved. It is for this reason that it is important that an attorney be contacted as soon as possible. Witnesses, which may disappear in a few days following a catastrophic injury, need to be identified, located and interviewed. In the event of an equipment failure or structural defect, these items need to be inspected as well as protected from being discarded or altered.
